Terms of Service

1. Agreement

By creating an account or using Locally Starved (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Who we are

Locally Starved is a technology platform serving the Illinois Valley that connects consumers, merchants, and independent-contractor drivers. We are not a restaurant, retailer, or logistics carrier — we facilitate transactions between users.

3. Accounts

You must be at least 18 to create an account. You are responsible for your credentials and all activity under your account. Provide accurate information and keep it up to date.

4. Consumer orders

Placing an order forms a direct contract between you and the merchant. Locally Starved facilitates payment and delivery via independent drivers. Refunds are handled per the merchant's stated policy.

5. Merchants

Merchants are responsible for menu accuracy, food safety, licensing, taxes, and their own payment processing (Square, Stripe, PayPal, or cash) as configured in their dashboard. Merchants agree to the fee schedule of their chosen Locally Starved subscription tier.

6. Drivers

Drivers are independent contractors, not employees of Locally Starved. Drivers agree to the fair-pay formula (Base + Mileage + Time + 100% of Tips) and to abide by all traffic and delivery laws. Drivers must carry valid insurance where required by law.

7. Payments & fees

Consumers pay the order total plus applicable delivery, service, and tip amounts as shown at checkout. Merchants pay platform fees according to their subscription tier. 100% of consumer tips go to the driver.

8. Prohibited use

No fraudulent, abusive, unlawful, or harmful use of the Service. No harassment of other users. No attempts to interfere with the Service.

9. Intellectual property

The Service and its content are owned by Locally Starved. Users retain rights to content they post (menu photos, reviews, etc.) and grant us a license to display it.

10. Disclaimers

The Service is provided "as is" without warranties. We do not warrant food quality, delivery times, or driver conduct. Consumers should inspect orders on delivery.

11. Limitation of liability

To the maximum extent permitted by law, Locally Starved is not liable for indirect, consequential, or punitive damages. Total liability is limited to the fees you paid us in the prior 12 months.

12. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account any time by emailing hello@locallystarved.com.

13. Changes

We may update these Terms. Material changes will be announced by email or in-app notice. Continued use constitutes acceptance.

14. Governing law

Illinois law governs these Terms. Disputes go to the state or federal courts in LaSalle County, Illinois.
